1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the website revivemoments.co and the related services (the “Service”) operated by Dobalo, Inc. (“Revive Moments”, “we”, “us”, “our”).

By creating an account, completing checkout, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Revive Moments is an online service that uses third-party AI technology to animate, upscale, and colorize photos uploaded by users. Outputs are made available for digital download from your account.

• Output quality depends on the quality, resolution, and content of the source photo. We do not guarantee any specific aesthetic result.
• Processing typically takes between 1 and 10 minutes and is performed by third-party providers (including Higgsfield and Replicate).
• The Service is intended for lawful, personal, non-commercial use unless we have agreed otherwise in writing.
• We may refuse, remove, or modify content that violates these Terms or applicable law.

3. Account Registration

You must provide a valid email address and complete checkout to create an account for paid features. You are responsible for keeping your credentials secure and for all activity on your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to enter into these Terms.

We reserve the right to suspend or terminate accounts where we have a reasonable belief of fraud, abuse, or violation of these Terms.

4. Subscriptions, Pricing, and Auto-Renewal

Paid plans are offered as recurring subscriptions billed weekly or monthly, depending on the plan you select. All amounts are stated in U.S. dollars unless otherwise indicated and are exclusive of any applicable taxes.

Introductory pricing. Some plans are offered with a discounted first billing period (for example, $1.49 for the first week). After that period, the plan automatically renews at the regular price disclosed at checkout (for example, $6.99 per week).

Automatic renewal. By subscribing, you authorize us to charge your payment method on file at the start of each billing period until you cancel. Renewal will occur at the then-current price. We will send a renewal reminder by email at least 7 days before the first paid renewal.

Failed payments. If a charge fails, we may attempt up to three additional charges over seven days. If payment ultimately fails, we may suspend paid features.

Credits. Unused credits expire at the end of each billing period and do not roll over unless the plan description says otherwise.

5. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you retain access until then. You can cancel:

• From your account settings (recommended), or
• By emailing support@revivemoments.co.

Except where required by law or under our refund policy below, fees already paid are non-refundable and there are no partial refunds for unused time.

6. Refund Policy

We offer a refund where all of the following apply:

1. You experienced a documented technical issue that prevented you from using the Service (for example, animations could not be generated due to a system error). Aesthetic dissatisfaction with output quality, accidental purchases, and change of mind do not qualify.
2. You have used no more than 3 credits on your account.
3. You request the refund within 30 days of the original purchase.

Credit reissue. If a single animation fails due to a technical error on our side, we will automatically refund the credit consumed, independent of the refund policy above.

Approved refunds are issued to the original payment method within 14 days. To request a refund, contact support@revivemoments.co.

7. User Content and Acceptable Use

You may only upload photos you own or for which you have all necessary rights and permissions, including the consent of every identifiable person depicted.

Prohibited content and conduct:

• Photos of minors in inappropriate contexts.
• Unlawful, defamatory, harassing, hateful, violent, sexually explicit, or otherwise objectionable content.
• Photos of identifiable people uploaded without their consent.
• Deepfake or manipulated content created to deceive, defame, or depict a real person without their consent.
• Content that infringes the intellectual property, privacy, or publicity rights of any third party.
• Automated scraping, reverse engineering, circumventing technical measures, or creating multiple accounts to evade limits.

We may remove content, suspend, or terminate accounts that violate these Terms, without refund. You agree to indemnify and hold us harmless from claims arising from your unlawful use of the Service.

8. License to Generated Content

Subject to your compliance with these Terms, we grant you a non-exclusive, worldwide, perpetual license to use the videos and images we generate from your uploads for personal, non-commercial purposes. Commercial use requires our prior written approval.

We do not use your photos or generated outputs to train AI models, and we do not share them with third parties for marketing.

9. Storage and Deletion

• Temporary funnel uploads with no purchase are deleted within 24 hours.
• Unprocessed account uploads are deleted automatically after 30 days.
• Generated videos remain available while your subscription is active.
• After cancellation, your media is deleted within 30 days.
• You may request immediate deletion at any time at support@revivemoments.co.

You are responsible for keeping your own backups of any content important to you.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Maintenance, updates, third-party outages, and other events may cause temporary unavailability.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY PARTICULAR RESULT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOBALO, INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow limitation of certain damages, so portions of the above may not apply to you. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Dobalo, Inc. and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your User Content, or (c) your breach of these Terms or applicable law.

14. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated by reference into these Terms.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date and, where appropriate, communicated to registered users by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Subject to mandatory consumer-protection laws of your place of residence, the state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to their personal jurisdiction.

17. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dobalo, Inc. concerning the Service.

Severability. If any provision is held to be unenforceable, the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of that provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
